PHILLY BONEHEAD SENTENCED TO HOUSE ARREST FOR ASSAULT

This guy has been busted so many times for so many stupid things, you are pretty much living on borrowed time the closer you are to him. And so is he. He got cut what we will bet will be his final break last week. He is going to serve almost two years house arrest for an assault on a former friend who lived in the same building with him and his girlfriend. Why did he assault him? Because the friend asked him to turn his stereo down. Normally house arrest would be expected, but Phy has been chauffeured around by police since he was a kid, earning those rides for various reasons like drugs, theft and for just being a general dumbass. But the judge decided to give him less than the minimum five years in prison because he just bought a house and has a kid. We actually think that was an honorable gesture on the part of the judge though. This will give Joey’s daughter a chance to get to know him for a little while – before he effs up again.

A member of Keystone State “Skinheads” was sentenced July 2 to 11 to 23 months house arrest for the assault on a neighbor and former friend almost two years ago.

The sentence came despite the objections of District Attorney Matt Glazer, however. Joseph Phy, 27, convicted in April of aggravated assault, was looking at a minimum of five years, per the standard sentencing guidelines, given his past arrest record. That record included over a dozen arrests, nine of them while a juvenile, when he was put in a facility and a program for incorrigible youth. His adult criminal record includes a burglary conviction for which he was sentenced to jail time and probation, and a dismissed weapons possession arrest. Phy was even arrested in Bucks County while this case was pending on a criminal mischief charge.

Phy is an active KSS member and has participated in numerous events in and around Philadelphia. He was part of a group of Nazis that attempted in vain to protest a gay pride event in 2005, and stood with Philadelphia’s Fraternal Order of Police when they protested a march for political prisoner Mumia Abu-Jamal.

Judge John J. Poserina Jr. took pity on the local neo-Nazi because he and his girlfriend Stacy Sautner have a two-year old daughter and a new house, all of which would suffer if he went to jail. Sautner testified that the family relies on his income for support. Phy’s attorney also presented letters of support for Phy, including one from his employer at Metal Stock, Inc. 4901 Cottman Ave. in Philadelphia. Phy, who started to let his hair grow out, spoke himself to how he “went overboard” when his neighbor asked him to turn his stereo down, resulting in a fight that caused the neighbor severe injuries.

Meanwhile, District Attorney Matt Glazer, presented only one letter, that of the victim himself. In the letter the victim noted that after the assault he has suffered seizures and migrane headaches. According to him, those injuries caused him to lose jobs as a machine operator. Glazer also cited Phy’s criminal convictions as well as his history of drug abuse since the age of 18, which included PCP. Glazer was not impressed by the fact that Phy had a house and family to be concerned about, saying that he was quite aware of what he was risking. “That’s what makes this incident so stupid,” Glazer said.

Following completion of the house arrest, Phy must also serve two years probation.
